A cordial invitation is extended you to visit our nursery.
Minimum order for shipment $2500
 

Terms:
     To those who have established credit, payment is net 30. If you do not have an established account, a cash down payment of 30% is required with your order and the balance due 15 days prior to shipment. All accounts over 30 days are subject to a service charge of 1.5% per month (18% annually) plus cost of collection.

Grading:
     We grade liberally in accordance with the horticultural standards adopted by the ANLA.

Conditions of Sale:
     Shady Valley Nursery prides itself in exercising the greatest care in keeping varieties true to name.  However, we give no warranty, expressed or implied, as to description, productiveness, or any other matter of our nursery stock we sell. It is mutually agreed that our liability for any errors or other causes is confined to replacement or refund not to exceed the original purchase price.
    We accept all orders subject to prior sales of stock and crop conditions. Orders shall be void should injury befall our stock from hail, fire, frost, error in count or other causes beyond our control. All orders are accepted without liability for non-performance if labor shortages or delay in transportation should prevent us from making delivery.
    Buyers agree that any dispute arising out of the sale of these goods shall be litigated in the Chancery Court of Grundy County, Tennessee, and that the State of Tennessee shall be the only forum for any and all litigation which may arise from any sale of goods by the seller. Either party not prevailing in such action shall be liable to the prevailing party for reasonable attorney fees.

Shipping Instructions:
     If you do not plan on picking up your order, we can arrange shipment with independent truckers and brokers. Our stock is packed with greatest of care, therefore, our responsibility ends upon delivery in good order to the carrier. All stock travels at the expense and risk of the purchaser. Freight charges are payable at time of delivery. Customers are responsible for unloading trucks.

Claims:
     Claims for any cause must be made on receipt of stock. We will not honor claims after goods have been accepted or when a report is not made within 10 days after arrival.
